The Federación Venezolana de Asociaciones de Consumidores y Usuarios (Fevacu) carried out a proposal of a Real Estate Pre-sale Law Project, presented before the Special Commission against the Collection of the National Price Index to the Consumer (IPC) and the National Assembly (AN).
The risk that the loss of houses represents to the Venezuelan families, as established in article 86 of the Venezuelan Bolivarian Republic Constitution, is one of the contingencies that deserve the direct intervention of the State. Article 86 of the Constitution establishes that housing is an integral and fundamental part of the Social Security System, to which every person has right as a public non-profitable service.
In relation to the IPC, Wolfgang Cardozo Espinel, explained that the proposal before the parliamentary instance is that it maintains the prohibition of every collection linked to the IPC, “as long as we consider this indicator as only a reference to the Venezuelan Central Bank (BCV) to measure prices, and not for use as a monetary correction for financing in real estate pre-sales”.
This way, companies in the construction sector of the country have been applying in recent times as a form of price adjustment, the INPC calculation in the housing sector, reaching in many cases to the point that those who chose a house must cancel more than 50% the value of the same for this concept, which for most means the loss of that option due to the impossibility of canceling such adjustment. According to Cardozo Espinel, they want to help through the application of these norms so they can strengthen the Housing and Habitat system with equitable financing which are fair, supportive and which will protect the safety and patrimony of the family.
